All Illinois Department Of Public Health's (IDPH) Short Message Service (SMS) programs, promoting HIV testing, run on the short code 36363. IDPH will not charge you to use this service; however your Wireless Service Provider may charge for sending and/or receiving messages and for air-time.
SERVICE TERMS:
1. IDPH provides several SMS (text messages) programs, including a location search SMS service, SMS Incentive Program, and On Demand Event Notifications (collectively, the 'Service'). Note: To process your SMS requests for the IDPH Service, you may be charged a fee to send and receive SMS messages, based on the terms of your Wireless Service Plan. All charges are billed by and payable to your Wireless Service Provider. Check with your Wireless Service Provider if you have questions about your Wireless Service Plan. Standard SMS message charges apply.
2. IDPH is not liable for delays in the receipt of SMS message, as delivery is subject to effective transmission from your Wireless Service Provider/Network Operator.
3. This service is available on the following Wireless Service Providers: Alltel Wireless, AT&T, Boost USA, Cellcom, Cellular One, Cellularsouth, Cincinnati Bell, Dobson Wireless (Cellular One), Midwest Wireless (Alltel Wireless), Nextel Communications, nTelos Wireless, Sprint PCS, T-Mobile USA, US Cellular, Verizon Wireless, Virgin Mobile.

Nonetheless, IDPH reserves the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect rights or property. When you complete forms online or otherwise provide IDPH information in connection with the Service, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name you are not authorized to use. If IDPH, in it's sole discretion, believes any such information is untrue, inaccurate, or incomplete, it may refuse you access to the Service and pursue appropriate legal remedies.
IDPH TEEN TEST DAY BACKSTAGE TICKETS SWEEPSTAKES
NO PURCHASE, APPLICATION OR TRANSACTION OF ANY KIND IS NECESSARY TO ENTER THE SWEEPSTAKES.
Eligibility: This sweepstakes is open to legal residents of the State of Illinois, 13 years of age or older. Employees (and household or family members of such employees) of Sponsor, Illinois Department of Public Health (ÒIDPHÓ), and Rip Road, LLC ("Mobile Administrator") and each of their respective affiliates, suppliers, advertising, promotion and fulfillment agencies, and affiliates are not eligible.
How to Enter: Beginning Feb 3, 2010, 12:00:00 a.m. (CST) and ending Feb 12, 2010 11:59:59 p.m. (CST), (the ÒSweepstakes Entry PeriodÓ), you can enter the sweepstakes for a total of two times by taking one of the below described actions.
(1) Text Message (First entry): Using your mobile phone send a text message ÒVIPÓ to the short code 36363. You will receive one text message response that confirm receipt of your sweepstakes entry and provide the opportunity to opt-out from further information from The Illinois Department Of Public Health. Entrants will be charged for their text messages in the same manner and at the same rates as they are charged for other text messages under their rate plan with their Wireless Carrier. See Mobile Terms of Service above. Message and Data Rates May Apply.
(2) Website Entry (Second entry): Users will be able to enter the sweepstakes via web by going to www.teentestday.com logging on and registering to enter the sweepstakes.
Eligible Entries: The Text Message Entries and Web entries shall be collectively referred to hereinafter as the "Eligible Entries". All Eligible Entries must be received by 11:59:59 PM (CST) on February 12, 2010. Limit two entries per person via text messaging and one entry per person via Web. The odds of winning the Sweepstakes depend on the number of Eligible Entries received. Entry into Sweepstakes is limited as specified in each of the above entry methods. There is a limit of one (1) Prize per entrant. All entries become the property of The Illinois Department Of Public Health, as applicable, and will not be acknowledged or returned.
Prize Winner Selection/Notification: Prize Winners (the "Prize Winners") will be randomly selected from all of the Eligible Entries received by The Illinois Department Of Public Health at 12pm February 13, 2010. Sponsors will make up to one (1) attempt over the 24 hour period following Prize Winner selection to contact the potential Prize Winners via the email address provided on his/her Mail entry form or via the mobile number associated with their winning text message entry. If a potential Prize Winner cannot be reached directly during the 24 hour period in which he/she is emailed, text messaged or called on the telephone number provided, the potential Prize Winner will be disqualified and an alternate Prize Winner will be selected from among the remaining applicable Eligible Entries received.
Prize Winner Verification: The potential Prize Winners must prove eligibility, including, without limitation, proof of age, and residence within three (3) business days of being notified as a potential Prize Winner. In the event of non-compliance by the potential Prize Winner such potential Prize Winner shall be disqualified and all privileges otherwise due as a Prize Winner shall be terminated and an alternative potential Prize Winner may be chosen from among all of the remaining applicable Eligible Entries received in Sponsors' sole discretion. The Prize Winner, must sign (his/her parent/legal guardian if Prize Winner is a minor) within three (3) days of receipt of such documents from The Illinois Department Of Public Health: (a) an affidavit of eligibility and release of Sponsors and their respective officers, directors, employees, agents, members, affiliated companies and subsidiaries, from any and all liability, loss, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with this Sweepstakes or the use/misuse or acceptance of any Prize or any portion thereof to be eligible for the Prize; and (b) except where prohibited by law, a promotional release granting Sponsors the right to use their name and likeness for advertising and publicity purposes without additional compensation. In the event of non-compliance by the potential Prize Winner such potential Prize Winner shall be disqualified and all privileges otherwise due as the Prize Winner shall be terminated and an alternative potential Prize Winner may be chosen from among all of the remaining applicable Eligible Entries received in Sponsors' sole discretion. Entry into this Sweepstakes constitutes agreement to sign such releases. The Prize Winner (or, if a minor, his/her parent or legal guardian) must also complete any additional legal documents provided by Sponsors (or third party on its behalf, if applicable) with respect to the Prize and return them as instructed within the timeframe specified by Sponsors or Prize Winner may forfeit the Prize at Sponsors' sole discretion. All decisions of Sponsors relating to the Sweepstakes are final. Sponsors expressly reserve the right to delay the announcement of the Prize Winner for creative or technical reasons or for any other reason Sponsors deem necessary.
Prizes: All weekly Prize Winners will receive one (1) backstage ticket. The prize is subject to change depending upon The Illinois Department of Public HealthÕs sole discretion, in Springfield, Illinois. Prize Winners are responsible for paying all costs and expenses related to the prizes that are not specifically mentioned, including but not limited to taxes. All Prize Winners who have not yet reached the age of majority in the jurisdiction in which they reside must obtain parental or legal guardian consent to be eligible as a Prize Winner.
Determination of Winners: Winners will be determined by random. Void where prohibited or otherwise restricted by law. All federal, state and local laws and regulations apply. Taxes are the sole responsibility of each winner. Winners may be required to sign an Affidavit of Eligibility and Liability/Publicity Release. If any winner does not meet eligibility criteria, the prize will be awarded to another entrant.
Odds of Winning: Odds of winning will depend the number of other entries received during that week.
Additional Terms: Sponsor reserves the right, in its sole discretion, to modify, terminate, or suspend the Sweepstakes should viruses, worms, bugs, unauthorized human intervention or other causes beyond SponsorÕs control corrupt or impair the administration, security, fairness or proper play of the Sweepstakes or submission of entries. Sponsor is not responsible for any human or other error that may occur in the processing of the entries, nor is it responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction or unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion. Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes; to be acting in violation of these rules; or to be acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or similar entry methods will void all such entries submitted by such methods. The user identified by a Wireless Carrier for any given wireless number used to enter by sending a text message will be deemed to be the participant and must comply with these rules. Only the number of prizes stated herein will be awarded. In the event any technical errors occur in the selection of winners and more prizes are claimed than the number of prizes being awarded as provided herein, Sponsor reserves the right to award the prizes by random drawing from among all eligible claimants.
Miscellaneous: By participating in the ÔIDPH SweepstakesÕ, participants accept and agree to be bound by these Official Rules and the decisions of Administrator, which shall be final, binding and conclusive on all matters. No transfer, assignment, cash redemption or substitution of prizes is permitted except by Sponsor due to prize availability and then with a prize of equal or greater value. By participating in this Sweepstakes each winner consents to the use of his/her name, photograph and/or likeness in any manner and in any medium for promotional purposes without additional compensation, except where prohibited by law. Sponsor is not responsible for printing or typographical errors in any sweepstakes related materials.
Release of Liability: All entrants release Sponsor, Administrator, and each of their respective parents, affiliates, subsidiaries, officers, directors, agents, employees, and all others associated with the development and execution of this Sweepstakes, from any and all liability with respect to, or in any way arising from, this promotion and/or acceptance or use of the prize and/or any traveling to any prize-related activities, including liability for personal injury, death, damages or loss.
